THE DHANASAR FRAMEWORK
USCIS grants National Interest Waivers based on a specific three-prong test
established in Matter of Dhanasar:
- Substantial Merit & National Importance: The proposed endeavor must offer
significant benefits to the U.S. economy, healthcare, education, or technology.
- Positioning: The applicant must be well-positioned to advance the proposed
endeavor based on their background and track record.
- Balance of Interests: On balance, it would be beneficial to the U.S. to waive the
job offer and labor certification requirements for this specific individual.
