K-1 - Fiancé(e) Visa

GENERAL ELIGIBILITY REQUIREMENTS

To qualify for a K-1 visa, the petitioner and the beneficiary must meet the following

USCIS regulatory standards:


  • Marital Status: Both the U.S. citizen and the fiancé(e) must be legally free to

marry (meaning any previous marriages must have been legally terminated).

90-Day Marriage Requirement: You must intend to marry within 90 days of the

fiancé(e)’s entry into the U.S.


  • In-Person Meeting: Generally, you must prove that you met each other in person

at least once within the two-year period before you filed the petition.
